Constitution

Article I Name
Section 1: This association shall be known as the “Magicians’ Association of Hong Kong,” hereinafter referred to as the “Association.”
Article II Objects
Section 1: To establish the fellowship between individuals who are interested in the practice and promotion of the art of magic and its advancement.
Section 2: To encourage and assist every effort, both individual and collective, which may tend to foster, elevate and advance the art of magic in the field of amusement, entertainment and culture, and to develop new sources of progress thereof, whenever and wherever possible.
Section 3: To facilitate social intercourse, exchange of ideas, and cooperation between those interested in or practicing the art of magic.
Section 4: To encourage the advancement of literature (literature including newspapers, books, magazines, videos, CD-ROMs and any information storage media now known or to be invented) and invention pertaining to the art of magic and to protect inventors and authors thereof so they may receive full reward for their creations.
Section 5: To adopt proper means to discourage false or misleading advertising of literature (as defined in Section 4), effects, tricks, merchandise, or actions appertaining to the magical arts, as well as any misrepresentations thereof.
Section 6: To promote and conserve the interests of those professionally engaged in the art of magic and discourage improper competition between the amateur, semi-pro and professional magician.
Section 7: To promote harmony among those interested in the magical arts.
Section 8: To advance the ethics of the magical profession, as well as those interested therein, insofar as their relationship in the magical fraternity is concerned.
Section 9: To oppose exposures of the principles of the art of magic except in literature (as defined in Section 4) devoted in such art for the exclusive use of magicians and devotees of said art; to oppose the expose of magical tricks or illusions to the public in any type of performance by whatever means employed.
Section 10: To promote the human treatment and care of live animals and birds whenever employed in magical performance and to discourage the use of such animals and birds whenever such use might subject them to maltreatment, injury, or death.
Article III Relationship with Other Magical Organizations
Section 1: The Association shall be the Ring 277 of the International Brotherhood of Magicians.
Section 2: The Association shall be the Assembly 264 of the Society of American Magicians.
Section 3: All Life Members and Active Members of the Association shall be Active Members of the International Brotherhood of Magicians and Assembly Members of the Society of American Magicians.
Section 4: The Association shall be a member society of the Fédération Internationale des Sociétiés Magiques.
Section 5: The Association shall be founder member and council board member of Asian Magic Association
Article IV Membership
Section 1: Any reputable and desirable person 18 years of age or over, who has been interested in magic for at least two years, is eligible to “Active Membership.”
“Active Members” shall be those who have passed the Active Member Test (as designed from time to time by the Executive Committee), been accepted by the Association, and are in good standing. They shall have the right to vote in any meeting, and have the right to be elected to serve on the Executive Committee.
Section 2: An application of Active Membership shall bear the endorsement of at least two Active Members, confirming that the relevant membership applicant is a reputable, desirable person, of good moral character, worthy of membership and that he/she has been interested in magic for at least two years.
Section 3: Within three months becoming an Active Member, an Active Member shall apply for Active Membership of the International Brotherhood of Magicians and Assembly Membership of the Society of American Magicians.
Section 4: Any reputable and desirable person 18 years of age or over, who is interested in magic, is eligible to “Associate Membership.”
“Associate Members” shall be those who have been accepted by the Association, and are in good standing. They shall have the right to vote in any meeting, but do not have the right to be a member of the Executive Committee.
Associate Membership shall expire in two years, and he/she must apply for Active Membership, unless the Executive Committee has agreed to an extended duration.
Section 5: Any Associate Member can apply for Active Membership provided that he/she has held the Associate Membership for at lease six months, and fulfilling all the requirement for the application of Active Membership.
Section 6: Any Active Member is eligible to “Life Membership”.
“Life Members” shall be entitled to all rights and benefits of an Active Member but shall be exempt from the payment of annual dues.
Section 7: “Honourary Membership” may be conferred on those persons who have materially advanced the art of magic.
Honorary Membership shall only be conferred at a general meeting by an unanimous vote at this meeting. Membership thus granted can only be revoked at a general meeting by an unanimous vote.
“Honorary Members” shall be entitled to all rights and benefits of an Active Member but shall be exempt from the payment of dues and fees of the Association.
Section 8: Application of membership shall be submitted to the Executive Committee. The Executive Committee has the right to approve or reject the application without giving any reason. The applicant shall, if so required by the Executive Committee, attend any interview for the purpose of deciding his/her application.
If, within thirty days after the approval or rejection of a membership application, two or more Active Members by written notice to the Executive Committee object to such decision, such objected decision shall be reconsidered by the Executive Committee where decision for this instance is final.
Article V Quorum and Meeting
Section 1: The monthly meeting shall be held once in every calendar month, except the month in which Annual General Meeting is held. The Executive Committee shall decide the date of such meeting from time to time.
Section 2: The Annual General Meeting shall be held within the first month of every year.
Section 3: The following business shall be included in the agenda of the Annual General Meetings:
a) Consideration of the General Secretary’s report;
b) Consideration of the Financial Secretary’s report;
c) Consideration of the Program Secretary’s report;
d) The election of the Executive Committee members.
Section 4: Extraordinary General meeting shall be convened by the Executive Committee acting under the instructions of the President, or upon a written requisition made to the General Secretary and signed by not less than 20% of registered members. Such requisition shall specify the objects of the proposed meeting.
Section 5: A 7 clear day notice in writing by post or by phone shall be given to the members for all general meetings, and 40% of registered members shall form a quorum (provided that such members are present in Hong Kong).
If the quorum is not met, the meeting shall be postponed for not less than 14 days, and in such postponed meeting any 2 registered members shall form a quorum.
Section 6: The vote of an Extraordinary General Meeting or Annual General Meeting shall possess a higher authority than any other decision in all matters affecting the Association as a whole.
Article VI Composition and Duties of the Executive Committee
Section 1: The Executive Committee shall be composed of:
a) President
b) Vice President (Shall be 1 or 2)
c) General Secretary
d) Financial Secretary
e) Program Secretary (Shall be 1 or 2)
f) Publicity & Information Secretary
Section 2: The duties of the Executive Committee members are:
a) President
The President shall be the chief executive of the Association.
b) Vice President
The Vice President shall assist the President in all his duties.
c) General Secretary
The General Secretary shall be responsible for all general secretarial duties of the Association.
d) Financial Secretary
The Financial Secretary shall be responsible for all matters relating to finance of the Association.
e) Program Secretary
The Program Secretary shall be responsible for the coordination of the activities and functions sponsored by the Association.
f) Publicity & Information Secretary
The Publicity & Information Secretary shall be responsible for the Association's internal
and external information publishing affair.
Section 3: The Executive Committee shall conduct and manage the affairs of the Association. The Executive Committee shall have full power to delegate its management power to any person, group or committee.
Article VII Election, Vacancy and Term of Office
Section 1: The members of each Executive Committee shall be elected by the registered members by way of a secret ballot at a general meeting. The votes shall be counted and the result shall be declared at the general meeting.
Section 2: All registered Life Members and Active Members shall be eligible for nomination as an Executive Committee member.
Section 3: Prior to the above mentioned election, any Life Member or Active Member may expressly decline to act as an Executive Committee member, provided that such intention to decline shall be in respect of all positions of the Executive Committee. No person shall be elected as an Executive Committee member after his intention to decline has been communicated, in writing or otherwise, to the Executive Committee any time before the relevant election.
Section 4: Retiring Executive Committee members shall be eligible for re-election.
Section 5: Any resignation in the Executive Committee shall be approved by the Executive Committee.
Section 6: Vacancy in the Executive Committee shall be filled at an Extraordinary General Meeting called for that purpose by the remainder of the Executive Committee.
Section 7: The term of office of an Executive Committee member shall commence on the day after the general meeting in which he/she is elected to office, and shall cease on the day after the next Annual General Meeting.
Article VIII Proceeding of the Executive Committee
Section 1: A 2 clear day notice in writing by post or by phone shall be given to all Executive Committee members for all Executive Committee meetings, and 50% of Executive Committee members (one of whom shall be the President or the Vice President) shall form a quorum.
Section 2: Decision of The Executive Committee meetings shall be decided by a majority of vote.
Article IX Duties of Members and Code of Ethics
Section 1: The duties of every member include:
a) Exercising an interest in the Association, the International Brotherhood of Magician and Society of American Magicians; avoiding wrongful use of their name or authority, and regulating his conduct toward the Association, the fellow members, and the public in accordance with the objects of the Association.
b) Refraining from all exposures of tricks, illusions and magical principles and conforming to signed pledged of the Association and as prescribed in this constitution and any amendments thereto.
c) Not disclosing any information obtained within the Association to non-members, as such information is for the exclusive use of the members.
Section 2: Member’s Code of Ethics are:
a) Members publishing, editing, or otherwise involved in the sale and distribution of literature (as defined in Article II Section 4) on subject of magic, shall adhere to the following code of ethics:
i. Literature, in which magic is merely incidental to the plot or article, and which will eventually reach the public, shall not contain any exposure on magic.
ii. Literature on subject of magic which sell exclusively through recognized magical channels shall not be subject to censorship or price regulation.
iii. Literature on subject of magic shall not bear any inference of any approval of the Association. Authors may state they are members of the Association, the International Brotherhood of Magician and Society of American Magicians; however, authors shall not make any statement in said literature that he is or was a member of the Executive Committee.
b) Exposure of the principle or secret of any magical effect is prohibited. An effect which, by its nature, completely reveals its principle in the course of its presentation is a stunt and shall not be performed.
c) Members shall not furnish information concerning modus operandi of magical effects to the lay public through the medium of newspapers, magazines, radio, telephone, television, motion pictures, giveaways or through the use of any other means whatsoever whereby the same may be transmitted.
Article X Resignation, Suspension and Termination of Membership
Section 1: Any Life Member/Active Member/Associate Member may apply, in writing to the Executive Committee, to resign from the membership of the Association. Any such resignation shall only be considered by the Executive Committee if such Life Member/Active Member/Associate Member is in good standing.
Section 2: The membership of any Life Member/Active Member/Associate Member who has failed to attend the monthly meeting for three consecutive months, without the prior approval of the Executive Committee, shall be suspended.
Section 3: The membership of any Life Member/Active Member/Associate Member shall be suspended if his fees and dues (including, but without limitation, the entrance fees, annual dues and all other payments owned to the Association) of the Association have been outstanding for more than three months, without the prior approval of the Executive Committee.
Section 4: The membership of any Life Member or Active Member, who has been suspended from being a member of either the International Brotherhood of Magicians or the Society of American Magicians, shall be suspended.
Section 5: Membership suspension in respect of a Life Member/Active Member/Associate Member shall take effect upon receipt of the Executive Committee’s suspension notice (“Suspension Notice”). Unless the Executive Committee agrees otherwise, a suspended member shall cease to have any membership rights upon receipt of Suspension Notice.
If a suspended member fails to remedy the situation(s) giving rise to his/her suspension (such situation(s) shall be specified in the Suspension Notice) within three months after the date of the Suspension Notice, his/her membership would be terminated.
Section 6: Any member may have his/her membership suspended, terminated, or subject to other disciplinary action for any of the following reasons:
a) Unbecoming conduct;
b) Violation of this constitution;
c) Violation of any resolution in force and effect;
d) Violation of Member’s Code of Ethics;
e) Violation of the International Brotherhood of Magician constitution and by-laws;
f) Violation of the Society of American Magicians constitution and by-laws.
Section 7: Any member whose membership has been terminated may apply, in writing, to the Executive Committee for a reinstatement.
Article XI Fees and Dues
Section 1: New members shall be required to pay an entrance fee to the Association. The amount of the entrance fee shall be fixed by the Executive Committee and approved by the Annual General Meeting. The payment shall be submitted to the Association within the first month that they are accepted for membership.
Section 2: Subject to Section 3, Active members and Associated members shall be required to pay annual dues to the Association. The amount shall be fixed by the Executive Committee and approved by the Annual General Meeting. The payment shall be submitted to the Association within the first month of every year.
Section 3: New members who are accepted for membership after the first month of the year, are required to pay a pro-rata annual dues. The amount is one twelfth of the annual dues (as defined in Section 2), multiplied by the number of calendar months left for that particular calendar year. The payment of each new member shall be submitted to the Association within the first month after his/her membership admission.
Section 4: Life Members are required to pay a one-time payment of Life Membership Dues. The amount shall be fixed by the Executive Committee and approved by the General Meeting.
Section 5: Life members who are accepted for membership after the first month of the year, will have their pre-paid annual dues refunded. The amount is one twelfth of the annual dues (as defined in Section 2), multiplied by the number of calendar months left for that particular calendar year.
Section 6: The expenditure of the Association shall be spent on the general administration and promotion of the objects (Article II) of the Association.
Section 7: Associate memner or Active member of the age 60 years or above as at 31st December of the year immediate before any year is eligible to apply a reduction of 50% of his/her annual membership fees upon provided his/her original Hong Kong Identity Card. Associate member or Active member who is full time student in any educational institute in Hong Kong of age 21 years or below as at 1st January of that year is eligible to apply for a reduction of 50% of his/her annual membership fees of that year upon provided his/her original valid Student Card or other relevant proof. Effective date of this section: 1st January 2006.
Article XII Nature and Extent of Members’ Liability
Section 1: The Association is a registered society under Society (Amendment) Ordinance, Chapter 151. All registered members in the Association have unlimited liability and shall all be equally responsible, except that Executive Committee members shall bear twice the liability of each ordinary member.
Article XIII Dissolution of Society and Disposal of Assets
Section 1: Subject to Section 2, dissolution of the Association shall be approved at a general meeting by 75% of the voting members present.
Section 7: The Association may be dissolved without the calling of a general meeting if the membership should fall below ten Life Members and Active Members.
Section 8: All assets of the Association after dissolution shall be donated to the International Brotherhood of Magicians and the Society of American Magicians in equal portion.
Article XIV General
Section 1: An Emergency Cash Fund of HK$1,000 (One Thousand Hong Kong Dollars) shall be established every year. The President shall be authorized to make withdrawals from said fund.
Section 2: No Executive Committee member or member of the Association shall endorse any cheque or draft made payable to, or belonging to the Association, for any purposed except for deposit, to the credit of the Association, into the Association’s bank account.
Section 3: All proposals pertaining to the disbursement of funds of the Association shall originate and be approved solely by the Executive Committee.
Article XV Interpretation and Amendment
Section 1: The interpretation of this constitution shall rest with the Executive Committee; but the ultimate decision shall rest on general meetings.
Section 2: Amendment to this constitution shall be made at any general meeting by 75% approval of the voting members present. Any proposed amendments shall first be submitted to the Executive Committee for consideration at least 30 clear days prior to the general meeting.

第一章 名 稱
第一節 本會之中文名稱為「香港魔術家協會」,以下簡稱「本會」。
第二章 宗 旨
第一節 團結有志推動魔術藝術的發展及進步之人士。
第二節 鼓勵及協助使魔術藝術在趣味及文化上,有所促進或提升之個人或團體;與及無論何時何地於可能之情況下,推動魔術藝術發展。
第三節 促進魔術同好的交往,交流及互相合作。
第四節 鼓勵與魔術藝術有關之著作(著作包括報章、書藉、雜誌、錄影帶、光碟及其他已知或有待發明之資訊儲存媒體)和發明,及保護作者和發明者的應有權益及回報。
第五節 以適當方法,向錯誤引導或宣傳之著作(第四節所定義)及商品,以及錯誤表達之魔術效果,作出反對。
第六節 保護專業魔術從業員的權益,反對專業、半專業及業餘者間之惡性競爭。
第七節 促進各魔術同好間之和諧相處。
第八節 提升專業魔術表演者、業餘愛好者及一切有關人士之魔術專業操守。
第九節 除了在專為魔術界而設之著作(第四節所定義)外,反對公開魔術的秘密,以及一切公開魔術秘密之表演形式。
第十節 提倡在魔術表演中對禽畜人道對待,反對一切虐待、傷害或危害禽畜生命的魔術表演方式。
第三章 與其他魔術組織之關係
第一節 本會為國際魔術家協會之二七七分會。
第二節 本會為美國魔術家協會之二六四分會。
第三節 本會之所有永久會員及正式會員,須持有國際魔術家協會之正式會籍,及美國魔術家協會之分會會籍。
第四節 本會為國際魔術組織聯盟之成員組織。
第五節 本會為亞洲魔術聯盟創會會員及常任理事。
第四章 會 籍
第一節 任何十八歲或以上人士,行為良好,對魔術有興趣兩年或以上,均有資格申請成為本會之「正式會員」。
正式會員是指那些行為良好,通過「正式會員測試」(測試形式由內務委員會每次決定),被本會接納而記錄良好之人士。他們擁有投票,及被選舉成為內務委員會委員之權利。
第二節 任何正式會籍之申請,須擁有最少兩名正式會員之保證,證明該申請者行為良好,對魔術有興趣兩年或以上,有資格成為正式會員。
第三節 正式會員須於其正式會籍被接納後三個月內,申請成為國際魔術家協會之正式會員,及美國魔術家協會之分會會員。
第四節 任何十八歲或以上人士,行為良好,對魔術有興趣,均有資格申請成為本會之「附屬會員」。
附屬會員是指那些行為良好,被本會接納而記錄良好之人士。他們擁有投票,但未擁有成為內務委員會委員之權利。
除內務委員會同意延長外,附屬會籍於兩年後結束;該附屬會員須申請成為正式會員。
第五節 任何持有附屬會籍六個月以上之附屬會員,如符合正式會籍之申請資格,可申請成為正式會員。
第六節 任何正式會員均可申請成為「永久會員」。
永久會員享有正式會員之所有權利及福利,但可豁免繳交本會之年費。
第七節 「名譽會員」是給予一些對魔術藝術有重大貢獻之人士。
名譽會籍須於會員大會中提名及一致通過。該會籍之撤銷,亦須於會員大會中提出及一致通過。
第八節 名譽會員享有正式會員之所有權利及福利,但可豁免繳交本會之會費及年費。
第九節 會籍申請須向內務委員會提出。內務委員會可不提供任何理由,接納或拒絕申請。如內務委員會要求,申請者須會晤內務委員會委員,以助審批該申請。
第十節 無論該申請被接納與否,於初步決定後三十日內,如有兩名或以上之正式會員,以書面向內務委員會提出反對,申請個案會由內務委員會重新考慮;而該決定為最終之決定。
第五章 會議及法定人數
第一節 除舉行週年會員大會之月份外,每月例會於每個月份舉行一次。內務委員會每次決定開會之日期。
第二節 週年會員大會須於每年第一個月內舉行。
第三節 週年會員大會之議程須包括以下各項:
甲、審議常務秘書之報告;
乙、審議財務秘書之報告;
丙、審議節目秘書之報告;
丁、選舉內務委員會委員。
第四節 在會長要求下,或百份二十以上之會員,聯署向常務秘書提出要求,內務委員會可召開非常會員大會。如由會員要求召開,開會之目的及議程,須於聯署函件中列明。
第五節 會員大會須於會議最少七天之前,以書面或電話,通知與會之會員。會議之法定人數,為在港會員人數之百份之四十。
第六節 如未夠法定人數,會議須延至最少十四天以後舉行;屆時法定開會人數為兩名會員。
第七節 在影響本會之事務上,於非常會員大會或週年會員大會中,經由投票所產生的決議,凌駕於本會由其他途徑所產生之決議。
第六章 內務委員會之組成及職責
第一節 內務委員會由以下成員所組成:
甲、會長
乙、副會長(一名至兩名)
丙、常務秘書
丁、財政秘書
戊、節目秘書(一名至兩名)
己、宣傳及資訊事務秘書
第二節 內務委員會委員之職責:
甲、會長
會長為本會之行政總裁 。
乙、副會長
副會長須協助會長執行職務。
丙、常務秘書
常務秘書須負責本會之一般文書事宜。
丁、財政秘書
財政秘書須負責與本會財政有關之事宜。
戊、節目秘書
節目秘書須負責統籌本會舉辦之活動及節目。
己、宣傳及資訊事務秘書
宣傳及資訊事務秘書須負責統籌處理本會內外宣傳、資訊發放事務。
第三節 內務委員會負責運作本會,及管理本會之事務。內務委員會有權授予任何人士、小組或委員會其管理權力。
第七章 選舉﹑空缺及任期
第一節 內務委員會委員須於會員大會中,由會員選舉產生;投票過程以暗票形式進行。會員大會須即時點票及宣佈結果。
第二節 任何永久會員及正式會員,均有權被提名為內務委員會委員。
第三節 於上述選舉前,任何永久會員或正式會員,如對出任任何內務委員會職位均沒有興趣,可向內務委員會提出放棄其被選舉權。任何永久會員或正式會員於選舉前,向內務委員會提出放棄其被選舉權後,將不會被選舉為任何內務委員會委員。
第四節 卸任之內務委員會委員,擁有再被選舉之權利。
第五節 任何內務委員會委員,如辭退內務委員會,須經內務委員會批准。
第六節 如內務委員會出現空缺,內務委員會須召開非常會員大會,以填補該空缺。
第七節 內務委員會委員之任期,由其被選舉之會員大會翌日開始,至下一個週年會員大會翌日結束。
第八章 內務委員會之運作
第一節 內務委員會會議,須於會議最少兩天之前,以書面或電話,通知與會之內務委員會委員。會議之法定人數,為內務委員會委員人數百份之五十(其中一名須為會長或副會長)。
第二節 內務委員會會議之決議,須經由投票產生。
第九章 會員義務及專業操守
第一節 會員之義務為:
甲、支持本會、國際魔術家協會及美國魔術家協會,避免它們之名稱及權威被誤用,並對本會、本會其他會員及公眾保持良好行為及形象。
乙、遵守本會章,及於會籍申請表格上簽署之承諾,拒絕公開一切魔術之原理。
丙、拒絕透露任何從本會中獲得之資訊給非會員,因該些資訊只為會員而設。
第二節 會員須遵守以下專業操守:
甲、會員出版、編緝、售賣或批發與魔術有關之著作(第二章第四節所定義),應遵守以下操守:
一、在著作中,如魔術只為其中之情節,而該著作最終會落於公眾人士之手中的話,便不應把魔術方法在著作中公開。
二、如只在認可之魔術途徑中,售賣與魔術有關之著作,則不受限制,包括價錢方面。
三、在著作中,不應誤導讀者或暗示該著作為本會認可。作者可於著作中指出其為本會、國際魔術家協會及美國魔術家協會會員之身份,但不應以其現職或曾任本會內務委員會委員,或相類似字句作宣傳。
乙、拒絕公開任何魔術效果之原理及秘密。如果一個魔術表演,於正常之表演情況下,完全把它的原理揭露的話,此表演是不適當的;會員不應作出此類表演。
丙、拒絕把任何魔術的表演方法,透過非魔術類別之報章、雜誌、電台、電視台、電影、傳單或任何相類似之途徑,提供給公眾人士。
第十章 會籍之辭退、暫停及終止
第一節 任何記錄良好之永久會員、正式會員或附屬會員,有權以書面,向內務委員會申請辭退會籍。
第二節 任何永久會員、正式會員或附屬會員,未經內務委員會事先批准,連續三個月未有出席每月例會,將被暫停會籍。
第三節 任何永久會員、正式會員或附屬會員,未經內務委員會事先批准,欠交本會費用(包括會費、年費、及其他應繳付予本會之費用)三個月以上,將被暫停會籍。
第四節 任何永久會員或正式會員,如其國際魔術家協會或美國魔術家協會會籍被暫停,將被暫停會籍。
第五節 有關之永久會員、正式會員或附屬會員,於收到內務委員會之「會籍暫停通知」時,其會籍開始被暫停;除內務委員會同意外,其會員權利及福利均被終止。
會籍被暫停之會員,如他/她於三個月內,未能就引致其會籍被暫停之事件作出改正(該事件將於「會籍暫停通知」中書明),將被終止會籍。
第六節 會員如觸犯以下任何一項,將被暫停或終止會籍,或接受其他紀律處分:
甲、行為不良;
乙、違反本會章;
丙、違反本會之有效決議;
丁、違反會員專業操守;
戊、違反國際魔術家協會之會章或附例;
己、違反美國魔術家協會之會章或附例。
第七節 會籍被終止之會員,如欲恢復其會籍,須以書面向內務委員會申請。
第十一章 會費及年費
第一節 新會員須繳交入會費。該費用之數目,須由內務委員會提出,及於週年會員大會中通過。該費用須於會籍被接納後一個月內繳交。
第二節 除第三節所述條文外,正式會員及附屬會員須繳交年費。該費用之數目,須由內務委員會提出,及於週年會員大會中通過。該費用須於每年第一個月內繳交。
第三節 如新會員之會籍,於該年第一個月後始被接納,他/她須按比例繳交年費之一部份。該費用之數目,為年費(第二節所定義)之十二份一,乘以該年度尚餘之月份數目。該費用須於會籍被接納後一個月內繳交。
第四節 永久會員須繳交一筆過的永久會員會費。該費用之數目,須由內務委員會提出,及於會員大會中通過。
第五節 如永久會員之會籍,於該年第一個月後始被接納,他/她將獲發還已繳交年費之一部份。該費用之數目,為年費(第二節所定義)之十二份一,乘以該年度尚餘之月份數目。
第六節 本會之開支,須應用於本會之一般行政,及以促進本會宗旨(第二章)為依歸。
第七節 任何附屬會員、會員,於任何年度之前一年的十二月三十一日,已年滿六十歲或以上並能出示真香港身份證者,可申請將其會費獲百分之五十寬減。任何附屬會員、會員,為香港教育機構的全職學生,其年齡於該年度之一月一日在二十一歲以下,及能出示其有效學生證或其他相關證件者,可申請將其該年度會費獲百分之五十寬減。本節生效日期:二零零六年一月一日。
第十二章 會員責任之性質及界限
第一節 本會乃根據香港特別行政區法例第一五一章社團(修訂)條例註冊之社團,故此所有會員,均對本會承擔無限及均等之法定責任;惟每位內務委員會委員所需承擔之法定責任,為每名普通會員之兩倍。
第十三章 解散及財產處理
第一節 除第二節所述條文外,本會之解散,須於會員大會中得到百份之七十五出席會員贊成。
第二節 如本會之永久會員及正式會員數目降至十名以下,則可無須任何程序自動解散。
第三節 本會解散後之一切財產,將均分捐贈給國際魔術家協會及美國魔術家協會。
第十四章 常 規
第一節 本會每年須建立一個緊急事務基金,為數港幣壹仟圓正;會長可全權動用該基金。
第二節 所有給予本會之支票,必須存入本會之銀行戶口;任何會員或內務委員會委員,不應以私人名義把支票兌現。
第三節 任何有關動用本會基金之動議,只可由內務委員會提出及批准。
第十五章 詮釋及修訂
第一節 內務委員會擁有本會章之詮釋權,但會員大會擁有最終之詮釋權。
第二節 本會章可在任何一個會員大會中,有百份之七十五出席會員贊成時修訂;修訂動議須於會員大會三十天前,提交與內務委員會審議。
